We are about to go to the Planning Panel next week. Just to sum up, up until this point, the GE Council have not been forthcoming with clear and concise information to McKinnon residents about this entire planning process. Many documents, including the developer's plan, were not provided until AFTER the planning conference. And we had to press council for clarification after discovering that the MUZ was still on the table, even after the GE Council decided (at the last council meeting) to recommend GRZ2 to a Planning Panel. (without community consultation). In addition, the GE Council did not notify a number of C143 objectors of the upcoming Planning Panel next week. We need to make it LOUD and CLEAR that we demand consultation for such a large development that will affect residents and the entire McKinnon Village.

Just so you know: The Planning Panel coming up in May for C143 88-100 McKinnon Road, McKinnon, is in fact considering MUZ1, as this is the exhibited Amendment, as well as GRZ2. At the Panel Directions hearing a couple of weeks ago, when the planning panel asked Jacqui Brasher why Council had not chosen to formally abandon C143 and restart the amendment process for the change to GRZ2, her response was Council supported what was exhibited – which is MUZ1. We were not made aware of this, even in our letter from Jacqui Brasher after the council voted to recommend the GRZ2. We found this out when we attended the Directions Hearing a couple of weeks ago in preparation for the Planning Panel. There has been a lack of transparency in this process. If you thought that the council vote last month to recommend a GRZ2 took the MUZ1 off the table, we were wrong. The Planning Panel will be considering both. See our blog post.

The Planning Officer's report and agenda for Glen Eira Council meeting on Tuesday 21 March 2017
The planning officer’s report overlooked many of the objections raised including the most basic, ie. that Council has yet to undertake an objective analysis to determine and justify the most appropriate zoning or height limit. Residents clearly considered the currently proposed zoning and height limit both inappropriate and unacceptable. Five councillors need to vote against this amendment going through (either deferring the decision until the analysis and further consultation is undertaken or rejecting the proposal).
The planning conference is over (see blog post for summary) and we had an overwhelming number of objections. But it is not over, yet. According to the council agenda released on Friday 17 March 2017, the planning officer is recommending that council vote on Tuesday 21 March 2017 to send this amendment to an independent panel for their recommendation. The planning officer’s report overlooked many of the objections raised by residents. There are nine Councillors on Glen Eira City Council, and we now need five councillors to vote against this amendment (our request is that they abandon it in its entirety and that residents be consulted on the proposed re-zoning BEFORE any new amendment for this location is submitted to the Minister for exhibition).
It is not compulsory for Councillors to even show up at the meeting (which means if they do not attend the meeting, they cannot vote).
Follow the instructions below to lobby Glen Eira councillors to attend the meeting AND vote to abandon this amendment. Numbers count and we want to send a very clear message to Glen Eira Council that residents want this MUZ abandoned.

My name is (insert name) and I reside at (insert address).
Having objected to this amendment, I am now quite frankly astonished in reviewing the Officers Report for discussion at next Tuesday’s council meeting to see a recommendation that Council refer this to an independent panel – indeed it begs the question, were residents views actually listened to at all?
I am therefore writing to request that you attend Council meeting on the night of 21st March and vote to abandon this amendment on the following grounds:
The planning Conference was very well attended and all those who attended verbalised their objection to the amendment – the meeting ran for approx. 3.5 hours. Council advised that 90 households were informed about this amendment – they received 182 responses, 177 of which were objections. As was suggested by some residents on the night this alone should be sufficient grounds for the council to immediately vote to abandon the amendment as “you already have your answer”.
There was respect in the meeting for the applicants right to seek to re-zone their property but unanimous agreement that the inappropriate rezoning/redevelopment was being sought
The overwhelming sentiment is that this must not proceed and the following concerns raised by objectors at the Conference further reinforce this.
Lack of transparency
There is concern and frustration about the lack of transparency relating to this proposal, and a feeling that it was rushed through with undue speed and without public consultation given the significant impact the application will have on zoning & height limits going forward. This amendment was tabled at the September 2016 meeting of the previous council - the timing of the notification & the objection deadline just prior to Christmas when people are rushed and on leave or vacation is also a significant concern. This concern was reinforced when it was mentioned toward the end of the meeting that a sight line / building envelope plan existed for this site but had not been made available to the public and were not available for viewing on the night of the Planning Conference. Jacqui Brasher, Principle Strategic Planner, advised it would be made available on the website, the day after the conference!!. Whilst I understand that this does not suggest what the final build form for the site will be, to find out that it existed but was not made public is a cause for significant concern.
Mixed Use Zone & Four Storey Development is not appropriate to this area of McKinnon Village:
Mixed Use Zone, with a DDO proposing a 4 storey development is inappropriate for this location because of the surrounding residential zones (GRZ & NRZ). Mandatory residential height limits apply to 3 stories for GRZ and 2 stories for NRZ apply in this area affected by this proposal.
This amendment is proposing to introduce a 4 storey building in area clearly zoned as GRZ and NRZ. The question was asked a number of times on the night of the conference as to why this was not challenged in both planning & council prior to proceeding to Exhibition Phase and no answer was provided.
It was also suggested on the night that the rezoning currently requested is just a ploy to introduce a 4 level development, which will then become totally residential. This question was put to Jacqui Brasher, who on pressing, responded that “potentially this could happen” due to the economic viability of the current shops in the commercial area of McKinnon Village. (Note: the report prepared by Aimee Dash for the applicants also points out that the location currently “does not enjoy good exposure to passing traffic”, so why would a new mixed use development with limited parking options be viable?)
The site in question is an isolated pocket of industrial land which is totally surrounded by GRZ & NRZ zoned property. The only appropriate re-zoning is to these zones, and the Council’s own strategic plan supports this type of rezoning “encourage the conversion of isolated pockets of industrially zoned land to residential where residential land use surrounds such sites” (the Officers report mentions that council strategy also includes “encourage conversion of derelict industrial sites to residential or mixed use activity where appropriate”) – however that point is totally irrelevant as the site in question is not “derelict” - it is in fact an active working site and has been and continues to be in continuous use. Additionally, the Officers report fails to mention that The Municipal Strategic Statement Clause 21:07 also encourages “Zoning non-conforming industrial uses to match the predominant surrounding zone” – in this case that is clearly residential zones GRZ and NRZ.
Several residents suggested that a more appropriate building type for this site would be 2 storey townhouses which would be in keeping with height & character of existing dwellings in this area.
Classifying this site as appropriate for an MUZ sets a precedent that any former industrial land can be rezoned MUZ even though it is not located within the core of a centre (centre now being defined as either activity or neighbourhood centre), need not be accessible by a major road or by hard rail (tram or train), can have a height higher than the surrounding zones and can negate the concept of transitioning (highest at a centre's cores, lower as it approaches the NRZ areas). This is will set a precedence that applies across the municipality because it is outside the parameters set by Glen Eira's other MUZ's.
Site coverage explained at conference
There was a lack of clarify about site coverage being requested - Aimee Dash (Dash Urban Planning who created the proposal for the applicant) stated that the building would only have 60% site coverage, however the site line/building envelope plans provided the day after the conference suggests boundary to boundary coverage. She was also unclear about set-backs on the property – first stating that the front boundary would be in line with existing houses in the surrounding area, and then later stated that the front boundary would be at footpath. All of which left those who attended the conference unclear about what exactly was being proposed for the site.
Neighbourhood Character & Village Feel
McKinnon is a village with a unique character and there was general sadness about how this will impact the Village feel which is the reason people chose to live here. While residents accept that change is inevitable, they do have the expectation that Council, as the Local Planning Authority, will undertake town planning in accordance with contemporary, accepted planning principles and concepts. Residents have clearly stated that rezoning this site to MUZ and allowing a 4 storey building does not meet this expectation. The lack of protection is a significant concern as highlighted by the absence of a structure plan for McKinnon Road, detailed design overlays, a plan for additional public open space and a very outdated Municipal Strategic Statement. What we need from Glen Eira Council is a plan for sustainable development, not the ad hoc approval of totally inappropriate developments.
Privacy and sunlight and decrease of quality of life
Concerns about privacy & overlooking, and impact on sunlight in neighbouring properties
Gateway
The concept of a gateway building was discussed. One objector suggested that McKinnon currently has a Gateway Building, the McKinnon Hotel, which has been recently renovated. Also the site at the corner of McKinnon & Jasper roads, which is currently in the process of redevelopment, are gateway buildings. If a “Mixed Use” development is required, the commercial area of the village would be a more appropriate location. There is no requirement for a “Gateway” building at this end of McKinnon Road. There's more to a gateway than height - a complex of townhouses would serve the same purpose.
Drainage, Flooding & Waste Management
Concerns about impact on drainage & sewage systems and flooding were brought up. This was a big concern for a number of residents, and some gave examples of recent flooding. There is a belief that any basement car parking in a flood plain area will impact the surrounding homes. We are sitting on a flood plain and residents voiced concerns about previous floods and the inadequacy of the drainage, which has come up numerous times at council meetings over the years and has yet to be fixed. The issue of waste disposal was brought up. Potentially 50 plusapartments on that block. How will that affect the surrounding area in terms of elimination of waste and waste pickup?
Traffic
There were concerns about impact on traffic & parking. A number of objectors pointed out how difficult it is to currently navigate the roundabout at Wheatley Road without the impact of a major high density development. Also concern about the proposed entry point to a development which would be via a narrow rear lane 3.5m wide – barely wide enough for a single car width, and currently a blind entrance, and also located near the Roundabout. Also of note: no clarification was provided on exactly what the new tender advertised by the council entails for this roundabout.
Visual bulk
A four (or even three) storey building will dominate the landscape, its visual bulk will be seen from the top of McKinnon Hill.
As the final decision on whether or not to proceed with this amendment now sits totally with the Council, and Council must take ownership to make this decision and not abdicate responsibility to an independent panel, I once again urge you to vote to abandon this amendment in its entirety and request that residents be consulted on the proposed re-zoning BEFORE any new amendment for this location is submitted to the Minister for exhibition. This is an opportunity for the recently elected council to make a strong statement that confirms its commitment to listening to the views of the residents and opposing inappropriate & adhoc development.

Enough is enough
The Glen Eira Council has presented C143 Amendment to the planning minister and is currently being exhibited. The proposal is to change the zoning from INZ zone (Industrial Zone) to a MUZ (Mixed Use Zone).

Buried in the proposal is a Design and Development Overlay (DDO) for a 4 storey medium-density development. That is 14.5 metres high! There are no provisions for side and front setbacks. And worst, this 4 storey proposal is surrounded by mostly one storey residential zones.
This rezoning MUST NOT GO THROUGH. If it does, it will disastrous and can't be reversed.
There was no consultation with the community.
McKinnon Road, near Wheatley Road is NOT in a commercial zone. Is is not an Urban Centre or a Neighbourhood Activity Centre. McKinnon is a village. A development like this could destroy McKinnon Village and the surrounding area. Just take a look at Bent Street and Nicholson Street. The Domino Effect.
This proposal is inappropriate for this location.

Buried in the proposal is a Design and Development Overlay (DDO) for a 4 storey medium-density development. That is 14.5 metres high! There are no provisions for side and front setbacks. And worst, this 4 storey proposal is surrounded by mostly one storey residential zones.
This rezoning MUST NOT GO THROUGH. If it does, it will disastrous and can't be reversed.
There was no consultation with the community.
McKinnon Road, near Wheatley Road is NOT in a commercial zone. Is is not an Urban Centre or a Neighbourhood Activity Centre. McKinnon is a village. A development like this could destroy McKinnon Village and the surrounding area. Just take a look at Bent Street and Nicholson Street. The Domino Effect.
This proposal is inappropriate for this location.
- Increase in traffic on a small road, near the roundabout
- A four-storey building of 14.5 metres surrounded by GRZ1 (General residential) and NRZ1 (Neighbourhood Residential)
- Increase in noise

Mixed Use Zone inappropriate for site
McKinnon Road is not a major retail centre – it is a village with neighbourhood shops clearly zoned Commercial (as shown on above zoning map). The proposed Mixed Use Zone at 88-100 McKinnon Road is inappropriate for this location because of the surrounding residential zones. Because this site is an isolated pocket of industrially zoned land surrounded by residential zones, the only re-zoning appropriate to this area of McKinnon Road is residential. Any zoning change to Mixed Use is completely out of step with its surrounds.
Design & Development Overlay
The proposal to apply a DDO to this site with a height limit of 14.5m (4 storeys) is inappropriate to the surrounding residential zones where height limits are clearly set (max. height of 2 storeys in NRZ zones and 3 storeys in GRZ zones). Having 4 storeys will not make it a “gateway building.” The size and character will create an anomaly building and dominate the landscape, creating visual bulk and physical mass. This proposed building will also have a detrimental effect on privacy by overlooking surrounding properties, and substantially cause sun shadow, decreasing natural sunlight.
Increased traffic on street
McKinnon Road is not a major road. Allowing a mixed zone development will cause traffic gridlock. The property is located close to the Wheatley Road Roundabout (4 exit intersection, with 2 slip lanes). The entry/exit lanes are narrow – any large redevelopment will add traffic congestion and increased difficulty for residents parking in neighbouring residential streets. There is also very limited on-street parking between Wattle Grove and Wheatley Road Roundabout (total 23 car parking spaces / mix of 2 hour and all day).
Other issues with Mixed Use Zone
MUZ is not appropriate zoning for McKinnon Village, and especially for this location within the village because of the types of the businesses it allows. The MUZ does not require a planning permit for businesses operating with extended trading hours, e.g. Convenience Mini-Marts, Takeouts and Food & Drink premises. These type of activities will compromise the surrounding residents’ right to quiet enjoyment on their premises. The industrial buildings currently located on the site work on very set hours, and reduced hours on week-ends, so have minimum impact.

Ultimately this will destroy the overall character of McKinnon and sets a dangerous precedent for the safety of our neighbourhood.
